Question is: How Does One Hold a City Liable?

One does not have to take a public official to court and spend all that money poking holes in government immunity. Liability is in obtaining and holding office.
Judgment is in the vote. One simply has to get the facts out to the public and let them vote.
In the case of Englewood's City Council members, some of them are up for re-election in November, 2009. Specifically, the Mayor, (at large) District 2 and District 4 council persons.
The others remain on council unless someone goes to the trouble and expense of funding a special recall election and then another election to fill the seat should the recall be successful.
The City Council is the only one which can fire a City Manager, or provide benefits and salary and raises to him. But, at present, the Council is enamored with City Manager Sears.
Since the City Council has pre-occupied themselves with silly matters such as three day-old dog and cat poo, perhaps this is an issue worth looking at.
Beyond silliness, Mayor (Jim Woodward) has promoted and funded further prosecution of various small business owners for painting their aging structures with murals or faux painting.
How did the City fund these prosecutions? With your tax dollars.
At first, Council chose only to prosecute the Alice in Wonderland scene on Englewood's head shop. Then, they realized that to prosecute only one business (deemed unsavory) would make them liable for violations of freedom of speech.
So, Englewood invited a used car shop and other regular business owners to the party. Englewood v. business murals prosecution has been in the court system for a year and a half, eating up residents' tax money.
Methinks what with the wooing of artists to Englewood through the previous Mayor, Olga Wolosyn's influences, the hypocrisy of prosecuting business owners for murals is, well, inflammatory.
What does Englewood's Council get from being puppeted by the City's Manager?
Maybe it's intimidation and good-ol-boy pandering that prevented Council from taking the reigns to direct the City Manager into their vision of community, and their understanding of citizen's rights.
This Council has directed Englewood's City Manager to send Violation Notices to various homes, subsequently prosecuting various home-owners for violating the City's definition of household.
When the coffers are funded, Council's salary,transportation and parties are all wrapped up with a pretty bow for them, it's obvious who will cater to the City Manager's whims. Each person on Council is bought and paid for.
Whose coffers do they utilize to fund Staff actions serving to criminalize Englewood residents? None other than the Englewood taxpayers' coffers. No skin off their own noses to be sure.
Does Englewood realize that their City Manager Sears is the best paid manager south of the Denver line? Well, that includes cities such as Cherry Hills, Greenwood Village, Lone Tree, Elizabeth and Highlands Ranch.
Does the city acreage warrant such pay? Not really. Englewood is a small city.
What has the City Manager done for you lately? Isn't it time Englewood elected a real Mayor/City Manager who can be held accountable to the residents?
